“The Protection of Information Bill is inherently unconstitutional.”

This is what Dr Laurie Nathan, research fellow at UCT’s Department of Environmental and Geographical Science, said at a discussion about the proposed Protection of Information Act and the Media Appeals Tribunal held at the Book Lounge in Cape Town last night.

Nathan, who is also affiliated with the Crisis States Research Centre at the London School of Economics, said that the principle of an open society is something which is found throughout our Constitution. The proposed Protection of Information Act will however, create a society of secrets.

Limiting rights

The Constitution of the Republic of South Africa says that anyone has the right to have access to any information held by the state, but the Protection of Information Bill aims to keep this information from citizens. According to Nathan, the Bill defines national interest and security so broadly that this definition can be used to keep any and all information secret.

The Constitution also states that everyone has the right to freedom of expression, including freedom of the press, artistic freedom and academic freedom. If the Protection to Information Bill is passed it will  cancel this freedom.

Nathan said that the issue of a Media Appeals Tribunal is something separate to the Protection of Information Bill. The fact that it has been lumped together with the Bill in debates has created confusion, which furthers the cause of those advocating for the Bill, he said. According to Nathan, the questions raised about ethics and the media make sense, but the proposed Media Appeals Tribunal is definitely not the vehicle to address this. Neither is the Protection of Information Bill.

“When listening to Laurie Nathan I ask myself: ‘How can we stop this?’,” the writer Dr Sindiwe Magona said at the event. “If we don’t act now, it will become law. The freedom we fought for and gained in 1994 will shrink.”

Judith February, Head of IDASA’s Political Information and Monitoring Service, agreed that action from civil society is necessary to address this issue. IDASA is putting together a media statement entitled Let the truth be told: Stop the secrecy bill! which has been signed by more than 100 organisations. “People are making a mistake if they think this Bill will only affect journalists. In reality any information that an ordinary citizen applies for will be hidden. It will affect ordinary poor people more than anyone else.”

IDASA has been talking to grassroots organisations, who have before made use of the right to access to information from government. These organisations understand what the proposed Protection of Information Act will mean. They have also signed the media statement.

Furthermore, IDASA is mobilising community radio stations to reach the greatest number of people in South Africa.

February encouraged people to write letters to the newspaper and to flood Cecil Burgess’ inbox. (Burgess is the chair of the parliamentary committee that’s looking at the Protection of Information Bill.)

An awareness workshop on xenophobia held by the City of Cape Town at the Cape Town Civic Centre on 24 July 2010 is  proof that there are people in this city who are prepared to stand up for their brother and sisters from other countries.

The workshop aimed at reigniting the spirit of ubuntu in people’s minds. Many hands are better than one and if South Africans work together and make peace, the word “xenophobia” will remain only in our history books.

The City looked at factors that might contribute to these attacks. They felt that there is a need for community leaders to step out of their comfort zone and open the minds of communities.

The City found that communities might be lacking in political education about refugee rights. For this reason the workshop was held.

The organisers hoped to use this work to resolve issues that lead to these attacks. It set out the steps that needs to be taken to end the criminal violence.

The City feels that if Ward Development Forums, Ward and Street Committees, the Department of Social Development (both city and province) and church leaders could engage themselves in the communities they serve, they will be able to implement possible solutions.

THE WAY FORWARD

Ongoing, educational workshops can be conducted for local residents to be made aware of the Bill of Rights and refugees rights. Civil Society and Community leaders can also discuss these rights in their community and at sectoral meetings.

The power of advertising can be very useful to resolve these issues.  Posters, pamphlets, and word-of-mouth can lead people in the right direction.

As a social science research and communications consultancy working in the development sector, Creative Consulting & Development Works has seen the impact that communications can have on development issues and changing people’s perspectives.

Awareness programmes, targeting both high schools and primary schools would be very beneficial, as youth were also involved in these attacks.

WHO IS RESPONSIBLE?

Rallies are meant to mobilise communities, not only during the elections but also when issues like these crop up.  In this way the broader communities can be reached.

Community Based Organisations (CBO’S), Faith Based Organisations (FBO’S), and government departments can devise a mass awareness plan to reach out to those who are unaware of refugees rights. They have the power to facilitate and build cooperation between local and foreign nationals involved in businesses.

Humanitarian Agencies, Coordinating Committees and Government have to keep record of active organisations that deal with refugees. They have to support them to enhance their power to implement education and awareness programmes.

It is everyone’s responsibility to protect our rights and freedom. We can all live in love and peace with our brothers and sisters.

Women’s resistance to traditional gendered roles performed within the family structure, has led to new roles of performance in relation to work, marriage and childcare.

Throughout history certain norms were created determining gender roles. Women were perceived as the primary caregiver and men dominated in the workplace. Within the home these norms were learnt and thus maintained. In past decades this has apparently started to change with more women entering the working world.

 This shift in women performing work outside the home is associated with the female claim to autonomy. But how free are women really, even in their new roles? This autonomy claimed in many instances is contradictory.

 Women perform work within a gendered environment which reproduces the inequalities apparent within the family’ and other social institutions. For example, look at the glass ceiling effect the fact that women rarely reach prominent positions in a company due to discrimination. Also, very few women have yet been employed in male dominated areas such as the construction industry.

 There is apparently a lot of attention paid to the unequal position of women in the workplace, but the policies and structures implemented by government to address inequality in reality furthers the persistence of gender inequality. According to the Basic Conditions of Employment Act, women are entitled to at least 4 months of Consecutive  Maternity Leave, while men get 3 days Family Responsibility Leave. Does this not imply that the woman should stay at home and start raising the children while the man can go back to work almost immediately?  

 Top-down policy measures will not work as the historical construction of appropriate gendered behaviour is deeply rooted within the social fabric of society. It is only from below that this issue can truly be addressed.

Politicians are probably not more dishonest than the rest of us. It is just that they are in the spotlight and as such, their faults are magnified. At the same time it should be expected that if one is a public figure they need to conduct themselves on a higher moral plane than the rest of the masses. After all they are the people’s representatives and it is expected that, as the peoples’ ambassadors, leaders conduct themselves in a befitting manner. This includes being good role models for the youth and for the upcoming leaders.

What is ethical leadership in governance?

Some people tend to define their leaders behaviour according to what they themselves deem ethical. Mr. Tony Ehrenreich of COSATU in his address on the topic Thirteen years after apartheid: The quest for democratic governance said it was important that we define what we mean by ethical leadership. Ethical leadership should be a standard that is universal, a tool that guides as to the appropriate conduct. In democratic governance, ethical leadership is the kind of leadership that ensures there are regular free and fair elections, the marginalized and disadvantaged are included in society, there is separation of powers between the judiciary and government, giving both credibility and transparency. In addition all citizens must be given a chance to participate in building the democracy. These principles according to Mr. Ehrenreich are some of the significant gains that South Africa has made since the apartheid era. South Africa has thus succeeded in being a participatory democracy.

Ethical leadership in South African Governance

It is regrettably however, to that some political leaders have neglected the notion of ethical leadership and the principles of serving the people. They have instead become leaders that serve only themselves. A leader should work for the good of the people. Instead of point scoring against each other in parliamentary debates, political leaders should engage in constructive debate, about the real issues that affect the people. Despite being from opposing parties leaders should work together to ensure that developmental goals for the country are met. Leaders who speak the truth are ethical leaders. Many a times leaders make promises get votes and then they do not honour these promises when they are in leadership.

Leadership is about serving the people instead of amassing wealth for oneself. The tendency with some political leaders is to become career politicians who are more interested in getting wealth and security for themselves instead of doing the same for the people they serve. This is the reason why some leaders want to hold on to power, even when their followers no longer want their leadership. These same leaders tend then to become corrupt because they want to sustain their new lifestyle, or they engage in unscrupulous behaviour so that they can keep on eating’ while the rest of the population starves from lack of resources or poor delivery of services. This kind of unethical leadership pays loyalty to party bosses instead of to the electorate who voted them into leadership in the first place.

According to Mr. Ehrenreich, there comes a time when the citizenry must review the kind of leadership that is in place. Citizens exercise their democratic right by electing their leadership in elections. As such they have power, the power to choose. Power is thus not vested in leaders alone, but also in followers. Citizens of any country should hold their leadership accountable through the process of review and asking whether the kind of leadership they have, and are getting, is what they truly deserve.
